(1) A fee for the copying of any requested records by the town on town equipment shall be $0.10 per page for copies that are not color copies or $0.25 per page for color copies (if color copying is available on the town’s copier) and shall be paid by the person or entity requesting the copy of the record.

(2) The following fees shall be charged to any person requesting a copy of a law enforcement recording from the Homecroft police department (HPD) and/or the town of Homecroft:

(a) The “direct cost” for:

(i) The labor required to retrieve electronically stored data;

(ii) The labor required to:

(A) Obscure non-disclosable information; and

(B) Perform an administrative review to determine if all nondisclosable information has been obscured in a law enforcement recording; and

(iii) Any medium used for electronic output;

For providing a duplicate of electronically stored data onto a disk, tape, drum, or other medium of electronic data retrieval under IC 5-14-3-8(g), or for reprogramming a computer system under IC 5-14-3-6(c). However, if the labor described herein is performed by an attorney, the cost may not exceed reasonable attorneys’ fees.

(3) The following schedule of fees for the retrieval of data, the labor, and materials to perform any reproduction of a requested law enforcement recording, the necessary obscuring of nondisclosable information shall be as follows:

(a) The actual cost of media materials and town employee time expended for the reproduction and review and editing by town personnel but no more than $150.00;

(b) If the law enforcement recording must be reviewed by the town attorney then the cost shall include the attorney’s hourly rate, which must not be an unreasonable amount. [Ord. 2023-07-1, 2023; Ord. 16-04 § 3, 2016.]
